01Agreeing to these terms
TheCallMatch is operated by TheCallMatch LLC, a Massachusetts limited liability company ("we," "us," or "TheCallMatch"). These Terms of Service ("Terms") form an agreement between you and us. By sending a text message to TheCallMatch or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.
You must be at least 18 years old, or have permission from a parent or guardian, to use TheCallMatch.
02What the service does
TheCallMatch lets you text a phone number to us. We compare that number against a database of official phone numbers that we have collected from the public, official websites of banks, government agencies, and major companies. We then text you back one of two kinds of answer:
- A Match found result, meaning the number you sent matches an official number in our database.
- A No match result, meaning the number you sent is not in our database.
We can only tell you about the number you send us. We do not know who actually called you, what number called you, or the contents of any call. We are not affiliated with, endorsed by, or acting on behalf of any bank, agency, or company named in our database.
The service is provided free of charge. Standard message and data rates from your mobile carrier may apply.
03Important limits on what we can tell you
Please read this section carefully, because it explains what our answers do and do not mean.
A "Match found" result is not a guarantee of safety. It means only that the number you sent matches an official number we have on file. It does not confirm the identity of anyone who called you. Caller ID and phone numbers can be faked or "spoofed" by criminals. A scammer can make a real, official number appear on your screen. Always stay cautious, and never share your PIN, password, account numbers, or one-time codes, no matter what number appears.
A "No match" result does not mean a number is a scam. It means the number is not in our database. We do not have every legitimate number for every organization. Our database is focused on commonly impersonated banks, agencies, and companies, and it is growing.
TheCallMatch is a helpful tool to support your own judgment. It is not a substitute for caution, and it is not financial, legal, or security advice. When in doubt, hang up and call the organization back using the number printed on your card, statement, or their official website.
04Text messaging terms
TheCallMatch operates entirely over SMS text messaging.
Opting in
You opt in to receive messages from us by texting us first. We reply only in direct response to a message you send. We do not send marketing or promotional texts, and we do not enroll you in any recurring messaging program.
Message frequency: You receive a reply only when you text us. Message and data rates may apply.
STOP and HELP
You can text STOP at any time to opt out and stop receiving messages from us. You can text HELP at any time to get information about the service and how to reach us.
Carriers
Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier and is not guaranteed.
05Using the service properly
You agree to use TheCallMatch only for its intended purpose: checking phone numbers you have a genuine reason to verify. You agree that you will not:
- Use automated systems to send large volumes of messages or to scrape our database.
- Attempt to interfere with, overload, or disrupt the service.
- Use the service for any unlawful purpose or to harass others.
- Attempt to gain unauthorized access to our systems or data.
We may suspend or block access to anyone who misuses the service.
06Our content and brand
The TheCallMatch name, logo, website, and the content and design of the service are owned by TheCallMatch LLC and are protected by law. You may use the service as intended, but you may not copy, resell, or republish our content or brand without our written permission. Company and organization names referenced in our database belong to their respective owners and are used only to identify which organization a number in our database belongs to.
07Disclaimer of warranties
TheCallMatch is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, complete, or always accurate. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
08Limitation of liability
To the fullest extent permitted by law, TheCallMatch LLC and its owners, members, and operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the service. This includes any loss resulting from your reliance on a "Match found" or "No match" result, or on any information provided by the service. You understand that you use the service at your own discretion and remain responsible for your own decisions about whom to trust.
09Your responsibilities and indemnification
You are solely responsible for your own decisions and actions, including whom you choose to trust, what information you choose to share, and what you do after receiving a result from the service. To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless TheCallMatch LLC and its owners, members, and operators from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the service, your violation of these Terms, or your reliance on any result.
10Dispute resolution and class action waiver
Please read this section carefully, as it affects your legal rights.
Most concerns can be resolved quickly by contacting us first, and you agree to try to do so before starting any formal dispute. If a dispute cannot be resolved informally, you and TheCallMatch LLC agree that any dispute, claim, or controversy arising out of or relating to the service or these Terms will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court.
Class action waiver. You and TheCallMatch LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
If any portion of this section is found to be unenforceable, the remainder will continue to apply. This section does not prevent either party from seeking injunctive relief for the misuse of intellectual property.
11Changes to the service and these terms
We may change, suspend, or discontinue any part of the service at any time. We may also update these Terms from time to time. When we do, we will update the "last updated" date above. Your continued use of the service after a change means you accept the updated Terms.
12Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the service will be handled in the state or federal courts located in Massachusetts.
